Art Encounters and the Melbourne Studio of Art are operated by Art Encounters Pty Ltd, hereon referred to as us/we/our (ACN: 006 472 359 / ABN: 62 006 472 359). All references to you include you and/or all other parents and/or guardians (as applicable) of a prospective student or students. By enrolling yourself or your child or children (hereon referred to as your child) into one of our classes you agree to the following terms. We reserve the right to amend these terms at any time and continued attendance by you or your child after such amendments will constitute acceptance of the amended terms by you.
We run art classes for the following age groups:
- Junior Artists: Prep – Grade 2
- Young Artists: Grades 3-5
- Young Teens: Grades 6-8
- Teens: Grades 7-12

Places in our courses are only confirmed upon full and upfront payment of the term fees. Towards the end of each term, you are automatically reminded by email to enrol for the following term. Your or your child’s place in the following term will only be confirmed upon full and upfront payment of the next term’s fees.
Class sizes are strictly limited to the numbers available via our website, and due to the popularity of our classes we cannot reserve places. Any student who has not been enrolled online while there is availability will be unable to attend the course.
Please ensure you enrol your child in the correct age group. For example if your child is almost 8, but age 7 at the time of booking, please do not enrol your child in the 8-12 age group. For the benefit of all students we are very strict about this.
We reserve the right to refuse admission or cancel the enrolment of any student who poses a disciplinary problem or disrupts other students, as our teachers are not qualified to manage students with behavioural disorders, special needs or students who are unwilling to participate in the scheduled coursework. Please advise staff if your child has any behavioral or social difficulties that may affect them, and possibly others, within the classroom. These could include anxiety, being socially awkward, physical aggressiveness and shyness. Our staff we are not trained to care for children with severe behavioral syndromes.
By accepting these terms and conditions you are agreeing to your child being supervised outwith Art Encounters for the lunch break during the School Holiday Program.

Payment for course fees is to be made online only via our website, which ensures that your or your child’s place is immediately confirmed upon payment. Please contact our office for assistance if you experience technical difficulties while enrolling online.
- Refunds & Transfers
Please consider your booking carefully before enrolling as we do not offer credits, refunds or class transfers once payment has been processed.
- Trial classes
While we do not offer trial classes for potential students, please contact us if you would like to organise a complimentary tour of the school to help you determine if a course is suitable for you or your child.
Courses are designed to be sequential, so we strongly recommend that students attend every class in order to understand and build on the content taught.
Students should arrive for their class within and no earlier than 10 minutes of the scheduled start time, and should be picked up no later than 5 minutes after the conclusion of each class.
Students are not permitted to use mobile phones during class time, and all phones should be switched to silent. Teenage students may use their phone or iPod to listen to music while working.
We do not provide food or snacks during any program; however drinking water is always readily available.
Throughout term courses no food is permitted in the studio, however during school holiday programs students are required to bring along a morning or afternoon snack, and a packed lunch if enrolled in a full day session. Due to common allergies we ask that any food students bring to the studio does not contain nuts of any kind (including peanut butter), eggs (omelettes and hard-boiled eggs), seafood (fish, shellfish and crustaceans), and refined sugar products (chocolate and confectionary).
- Missed classes
We cannot be held responsible for any changes in work commitments or personal circumstances of parents or students, and we will not issue refunds or transfers for any missed classes.
Subject to class availability, we will offer a make-up class if you inform us in advance that you or your child will be unable to attend certain dates, you or your child is unwell, an unforeseen event occurs, or you or your child has had to miss a class due to a cancellation by staff. In the event a class is cancelled by staff, we will inform you as soon as we are able to do so.
We reserve the right to change teachers without notice because of circumstances outside of our control, and we will not issue a refund or transfer if there has been a change in the teacher of a class that you or your child is enrolled in. You agree that students are enrolled to undertake the course and there is no guarantee as to who the teacher will be.
- Reviewing work made outside of classes
Students may occasionally request their teacher to review work created at home, provided it is strictly related to the content of the class or homework recommended by the teacher.
Work that is independent of class content and completed outside of the studio may only be reviewed by appointment, and a tutorial fee of $100 per hour will be charged.
Students who request a review of work are asked to keep in mind that they are requesting a professional assessment from a professional artist, who is under no obligation to offer encouragement or discouragement, and that it is inappropriate to interpret any remarks regarding their work as personal criticism.
Basic art aprons are supplied to all students to wear during class time. All materials are provided in our children’s classes however our teenage students are required to bring or purchase their own materials for their course.
Material kits are available to purchase on check out on our online booking engine. Kits purchased through the school are priced with a 20% discount, and can be picked up at the beginning of the first class. If you or your child do not require the full material kit, individual items can be purchased in person at the studio during regular business hours. Please contact our office if you need a material list emailed to you.
- Gift Vouchers
Gift vouchers are available to purchase online via our website and whilst they are non-refundable, they remain valid for up to twelve months. Please note that purchasing a gift voucher does not guarantee a place in one of our programs.
We may take photographs of students participating in class or any artwork they create in class, and publish them on our website and social media pages, or for other advertising and publicity purposes. If you do not want you or your child and artwork to be photographed, we ask that you inform us before the commencement of the term. Nevertheless, if at any time you request that we remove any images of you or your child and artwork, we will endeavour to do so as soon as possible.
- Personal property
We cannot be held responsible for any personal property you or your child bring onto the premises, and we cannot be liable for any loss or damage to such property. For this reason, we recommend that students do not bring any valuables to class.
- Lost or damaged artwork
We cannot be held responsible for any lost or damaged artwork belonging to students. It is the responsibility of each student to collect their artwork at the end of each term, as any uncollected artwork may be removed or disposed of.
- Medical Care
Trained staff will provide basic first aid to the best of their ability in the event of a medical emergency. While we require that you inform staff of any medical conditions or allergies you or your child has, we will not be responsible for the administration of any medicines you or your child needs throughout the class.
- Emergency contact
If you are the parent or guardian of a student, we request that you are contactable via your registered details for the duration of each class, in the event of an emergency.
While we use age appropriate materials in our classes, you acknowledge that to the extent permitted by law, we cannot be responsible for any damage to your child’s attire or personal property from the use of these materials.
While we do everything possible to maintain a high standard of supervision in our classes to ensure the safety of students while they are on our premises, we cannot be responsible for the safety of students outside of classes. You acknowledge that to the extent permitted by law, we are not responsible for the safety of students outside their class time or outside our premises, which is why we ask that all students are collected immediately after their class.

If any part of these terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
- Entire agreement
Upon payment of our fees, these terms, as amended from time to time, shall represent the entirety of the agreement between you and us, and any changes must be in writing and agreed to by us to have effect.
20. Covid 19 Response
In the event of a lock down the following applies to our different programs:
1. Term Classes for Children aged 5 – 12 (Junior and Young Groups)
Students will be provided with a range of online classes that match the Tuesday, Thursday and Saturday A & B class time slots. Participants will be welcome to attend multiple online classes (4) during the length of the lockdown to provide extra activities and support during these times. The content of these classes will be amended to be workable online without the need for heavy materials that may not be manageable in the home environment. Commencing in Term 4, 2021, this age range of students will all receive a home art kit that will include basic materials with which to work during lockdowns (or for home practice).
2. Term Classes for Teenager Groups
Students will continue their studies online at the regular class time. In some cases, students will need to pick up their work in progress in order to continue on with the given project. Collecting times will be allocated to parents to pick up their work. Materials will be supplied where necessary. For those unable to collect work, Art Encounters will provide delivery of the work to the home address.
3. School Holiday Programs
In the event of a lock down during the school holiday programs, all students pre booked will receive a full credit towards future school holiday programs or online programs. These credits cannot be transferred to term classes.
